1. Definitions

• "Everkeep", "we", "us", "our" — refers to the business operating under the name Everkeep, located at 320 Sri Chan Road, Nai Mueang, Mueang Khon Kaen, Khon Kaen 40000, Thailand.
• "Services" — the document sorting sessions, Keepsake Filing System, and Guided Information Programme offered by Everkeep.
• "User", "you", "your" — any individual who accesses our website or books or attends a session.
• "Website" — the website at https://everkeep.cyou.
• "Session" — any in-person appointment at our Khon Kaen office under any of the three service types.
• "Agreement" — these Terms and Conditions, together with our Privacy Policy and Cookie Policy.

2. Acceptance of Terms

By submitting an enquiry, making a booking, or attending a session, you confirm that:

• You are at least 18 years of age.
• You have the legal capacity to enter into a binding agreement under Thai law.
• You have read and accept these Terms and Conditions in full.

If you are booking on behalf of another person (for example, a family member), you confirm that you have authority to do so and that the person attending meets the minimum age requirement.

3. Service Description and Scope

Everkeep offers three services, each described in detail on our website:

• Simple Sorting Session (฿3,600) — a brief, in-person session on organising and labelling personal retirement documents.
• Keepsake Filing System (฿13,500) — a folder template, labels, and checklists with a setup session.
• Guided Information Programme (฿30,200) — multiple sessions explaining, in general terms, how common retirement documentation is typically structured.

Important: All Everkeep services are administrative and educational in nature only. We do not provide financial advice, legal advice, or any regulated service. We do not assess individual entitlements, represent users before any organisation, or make any statement about what any individual is or may be entitled to receive. No part of any session constitutes professional advice of any kind.

Services are available to individuals located in or able to attend sessions at our Khon Kaen office. We do not currently offer remote or online sessions.

4. Booking and Payment

Sessions are booked by agreement following an enquiry. Payment is due before or at the start of the first session unless otherwise agreed in writing. We accept payment in Thai Baht (฿) by methods confirmed at the time of booking.

Prices are as published on our website and are inclusive of all materials described in the relevant service description. No additional charges apply unless agreed in writing before a session.

Cancellations and rescheduling:

• You may reschedule a session with at least 48 hours' notice at no charge.
• Cancellations made more than 48 hours before a scheduled session will receive a full refund or credit at your preference.
• Cancellations made within 48 hours of a scheduled session may be subject to a cancellation fee of up to 50% of the session price. We will use reasonable discretion in applying this.
• If we cancel a session, you will receive a full refund or a rescheduled appointment at your preference.

5. User Responsibilities

When using our website or attending sessions, you agree to:

• Provide accurate and complete information when making enquiries or bookings.
• Attend sessions at the agreed time, or provide timely notice if unable to do so.
• Not use our services for any unlawful purpose or in any way that could harm Everkeep or other users.
• Not attempt to obtain advice, representation, or any regulated service from Everkeep staff during sessions, as these fall outside our scope.
• Not reproduce, redistribute, or commercially exploit materials provided during sessions without our prior written consent.

6. Intellectual Property

All written materials, templates, checklists, labels, and other resources produced by Everkeep remain our intellectual property. When you purchase the Keepsake Filing System or attend the Guided Information Programme, you receive a personal, non-exclusive licence to use the materials for your own private purposes.

You may not reproduce, copy, sell, or distribute Everkeep materials to third parties without our written permission. This includes session notes, printed booklets, folder templates, and any other resources provided during sessions.

7. Disclaimers

Our services are provided in good faith on an "as is" basis for organisational and educational purposes only. We make no representation that:

• Any particular document structure or filing system will meet any specific legal, financial, or institutional requirement.
• Information provided during sessions is current, complete, or applicable to any individual's personal circumstances.
• Attendance at any session will produce any particular outcome, financial or otherwise.

Nothing in any Everkeep session, material, or communication constitutes financial advice, legal advice, or any form of regulated guidance. You are responsible for seeking appropriate professional advice from a qualified and licensed adviser for matters relating to your personal financial situation or entitlements.

8. Limitation of Liability

To the fullest extent permitted under Thai law, Everkeep's total liability to you in connection with any service shall not exceed the amount paid by you for that specific service.

We shall not be liable for any indirect, consequential, or special loss arising from your use of our services, including but not limited to loss of income, financial decisions made following attendance at sessions, or reliance on general information provided during the Guided Information Programme.

Nothing in these terms limits liability for fraud, personal injury caused by negligence, or any other liability that cannot be excluded under applicable Thai law.

9. Indemnification

You agree to indemnify and hold harmless Everkeep, its founders, and team members from any claims, losses, or costs (including reasonable legal fees) arising from your breach of these Terms and Conditions, your misuse of our services, or any misrepresentation you make in connection with a booking.

10. Termination

Either party may cancel a booked session or series of sessions by giving reasonable written notice. Refund terms are as described in Section 4.

We reserve the right to decline future bookings from a user who has acted in breach of these terms, used our sessions for purposes outside our stated scope, or behaved in a manner that disrupted the reasonable delivery of sessions.

Sections 6, 7, 8, 9, and 13 of these terms survive any termination.

11. Dispute Resolution and Governing Law

These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any dispute arising from or related to these terms or our services shall first be referred to informal resolution: please contact us at [email protected] and we will make reasonable efforts to resolve the matter within 14 days.

If informal resolution is not possible, disputes shall be submitted to the competent courts of Khon Kaen Province, Thailand, unless applicable Thai consumer protection law provides otherwise.

12. General Provisions

• Entire agreement: These Terms and Conditions, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Everkeep in relation to our services.
• Severability: If any provision of these terms is held to be unenforceable, the remaining provisions shall continue in full force.
• Waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right.
• Assignment: You may not assign any rights or obligations under these terms without our prior written consent.
• Notices: Communications to us should be sent to [email protected] or by post to our address below.

13. Changes to These Terms

We may update these Terms and Conditions periodically. The updated version will be posted on this page with a revised "Last Updated" date. Continued use of our website or services after changes are posted constitutes acceptance of the revised terms. We will endeavour to notify users of material changes by email where we hold contact details.
